Le plus avantageux pour le salari\u00e9 doit \u00eatre retenu.<\/p><p>Attention, on ne mixe pas une la r\u00e9ponse de la convention collective avec le code du travail et l\u2019accord d\u2019entreprise. Il faut choisir d\u00e8s le d\u00e9part la solution et s\u2019y tenir.<\/p><p>Dans tous les cas, le maintien de salaire se calcul sous d\u00e9duction des IJSS (Indemnit\u00e9s Journali\u00e8res de S\u00e9curit\u00e9 Sociale). Vous devez donc justifier aupr\u00e8s de votre employeur le montant des IJSS que vous avez per\u00e7ues pour votre arr\u00eat.<\/p><p>Pour r\u00e9pondre au plus grand nombre, basons-nous sur ce que nous dit le code du travail. En fonction de la nature de l\u2019arr\u00eat, le % du maintien du salaire sera diff\u00e9rent en fonction de la nature de l\u2019arr\u00eat.<\/p><p>Ainsi\u00a0:<\/p><ul><li>En maladie simple\u00a0: \u00e0 partir du 8<sup>\u00e8me<\/sup> jour d\u2019arr\u00eat, vous aurez droit au maintien de 90% de votre r\u00e9mun\u00e9ration brute pendant les 30 premiers jours d\u2019arr\u00eat puis 66.66% de votre r\u00e9mun\u00e9ration brute pendant les 30 jours suivants. Ces dur\u00e9es sont augment\u00e9es de 10 jours par tranche de 5 an d\u2019anciennet\u00e9. Ces dur\u00e9es sont \u00e9tudi\u00e9e sur 12 mois\u00a0: si vous avez plusieurs arr\u00eats au cours des 12 derniers mois il en est tenu compte pour calculer la dur\u00e9e maximale de versement autoris\u00e9e.<\/li><\/ul><ul><li>En accident du travail ou maladie professionnelle\u00a0: d\u00e8s le 1<sup>er<\/sup> jour d\u2019arr\u00eat, vous aurez droit au maintien de 90% de votre r\u00e9mun\u00e9ration brute pendant 30 jours, puis 66.66% de votre r\u00e9mun\u00e9ration brute pendant les 30 jours suivants.
